By accessing or using Color Match, you acknowledge that you have read and understood this Privacy Policy.
This Privacy Policy should be read together with the applicable Color Match Terms and Conditions and any additional privacy or permission notices presented within the App.

This Privacy Policy applies to information handled by Agile Styling Inc. in connection with Color Match. Third-party websites, online retailers, app stores, operating systems, payment platforms, and other third-party services are governed by their own terms and privacy practices.
When you register for or use Color Match, we may collect information that you voluntarily provide and that is reasonably necessary to create, maintain, and administer your account.
This may include your email address, account-related information, selected color-analysis system or color season, and other information you choose to provide through the App.
We do not intentionally collect personal information beyond information necessary to provide, administer, support, and improve Color Match or information voluntarily provided by the user.
Color Match uses the color season or related color-analysis information you provide to generate color-matching results and provide applicable App functionality.
You are responsible for ensuring that the color-analysis information you provide is accurate.
Color Match may analyze colors appearing in product images displayed by third-party online stores, websites, or other digital sources when you use the applicable shopping functionality.
Agile Styling Inc. does not control the accuracy, lighting, editing, compression, color reproduction, display characteristics, or other properties of images supplied by third parties.
Color Match allows users to voluntarily select photos stored on their smartphone or other compatible device for color analysis.
This functionality is designed primarily to analyze colors appearing in clothing, accessories, fabrics, and other physical items.
The Color Match color analysis itself is performed locally on the user's device.
Color Match does not automatically scan or access a user's entire photo library merely because the photo-matching feature is used. The level of photo access available to Color Match depends on the permissions and selections authorized by the user through the applicable device and operating system.
When using the photo color-matching functionality, the user identifies specific areas of an image for analysis. Color Match analyzes the selected areas to determine how the colors correspond to the user's selected seasonal color palette.
Although the color-matching analysis is performed locally on the user's device, limited image fragments corresponding to areas selected by the user during the color-matching process may be retained by Agile Styling Inc. for internal purposes.

The retained material consists of limited visual image fragments associated with areas selected during the color-matching process rather than the user's entire original photograph where only those fragments are required for these purposes.
These image fragments are used for Color Match's internal model-development and improvement purposes.
Agile Styling Inc. does not sell these image fragments or use them for third-party advertising.
Color Match is designed to process the visual information necessary to perform color analysis and improve its color-matching technology.
For image fragments retained for internal model training and improvement, Agile Styling Inc. does not intentionally collect or retain metadata associated with the original photograph, including:
The retained material consists of relevant visual image fragments rather than metadata from the original photograph.
Color Match does not use retained image fragments for facial recognition, determining a user's identity or location, creating advertising profiles, or third-party advertising or marketing.
We do not provide retained image fragments to RevenueCat.
Image fragments retained for internal model training, testing, evaluation, quality assurance, or improvement may be stored for a maximum of 60 days.
Following the applicable retention period, retained image fragments are deleted from our active training and analysis data, except to the extent that continued retention is required by applicable law or reasonably necessary to comply with a binding legal obligation.
The purpose of this limited retention is to allow Agile Styling Inc. to evaluate real-world visual color information and improve the accuracy, reliability, and performance of Color Match.
Retained image fragments are not maintained as a user's personal photo library or photo history.
Under the current functionality of Color Match, we do not intentionally retain separate photo-derived information such as GPS location data, EXIF metadata, persistent extracted color values, or individual photo-analysis histories for model-training purposes.
As between you and Agile Styling Inc., you retain your rights in photographs you select for use with Color Match. Agile Styling Inc. does not claim ownership of your original photographs.
By voluntarily selecting a photograph and using the photo color-matching functionality, you authorize Agile Styling Inc. to process the selected image as necessary to provide the requested functionality and to retain and use limited image fragments as described in this Privacy Policy for internal evaluation, testing, model training, development, and improvement.
This authorization does not transfer ownership of your original photograph to Agile Styling Inc.
You are responsible for ensuring that you have the necessary rights or authorization to provide any photograph you select for processing through Color Match.
Photo access is controlled through your device and operating-system permission settings.
Depending on your device, operating system, and settings, you may be able to authorize access to specifically selected photos, provide broader access, restrict previously granted access, or revoke access.
Color Match's ability to access photos will depend on the permissions you choose to provide.
You may manage, limit, or revoke applicable photo permissions through your device settings at any time.
Restricting or revoking photo access may prevent or limit your ability to use photo-based Color Match functionality but will not necessarily affect App functionality that does not require photo access.
We may use information collected or processed through Color Match as reasonably necessary to:
Where permitted by applicable law, we may also use aggregated or de-identified information for legitimate analytical, research, statistical, operational, and product-development purposes.
Color Match uses RevenueCat to support subscription management and related functionality.
In connection with these services, RevenueCat may process certain subscription, transaction, device, technical, or related information necessary to provide its services.
RevenueCat handles information in accordance with its own privacy practices and applicable legal and contractual requirements.
Color Match does not provide user-selected photos or retained image fragments to RevenueCat.
Agile Styling Inc. does not sell user personal information, original photographs, or retained image fragments.

Service providers may process information to the extent reasonably necessary to perform the services for which they are engaged and subject to applicable legal and contractual requirements.
Color Match may interact with online retailers, websites, app stores, operating systems, subscription infrastructure, RevenueCat, and other third-party platforms or services.
Agile Styling Inc. does not control the independent privacy, security, content, or data-handling practices of third parties.
Your interactions with third-party services may be governed by their respective terms, privacy policies, and practices.
To the extent permitted by applicable law, Agile Styling Inc. is not responsible for the independent privacy or data-handling practices of third parties that are not under our control.
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected or processed, including providing Color Match, administering accounts and subscriptions, complying with legal or accounting obligations, preventing fraud or abuse, resolving disputes, and establishing, exercising, or defending legal claims.
Different categories of information may therefore be subject to different retention periods.
Image fragments retained for the internal purposes described in this Privacy Policy are subject to the specific maximum 60-day retention period described in Section 5, except where longer retention is required by applicable law or a binding legal obligation.
Users may request deletion of their Color Match account and associated personal information.
Where account-deletion functionality is available within the App, users may use that functionality. Users may also submit a request by contacting info@colormatch.app.
Upon receiving and verifying a valid deletion request, we will take reasonable steps to delete or de-identify personal information associated with the account, subject to information that we are permitted or required to retain under applicable law or for legitimate purposes such as security, fraud prevention, accounting, dispute resolution, enforcement of agreements, or the establishment, exercise, or defense of legal claims.
Depending on applicable law and jurisdiction, users may have additional rights concerning their personal information, including rights of access, correction, deletion, or withdrawal of consent.
Nothing in this Privacy Policy is intended to restrict any privacy or data-protection right that cannot lawfully be restricted.
Agile Styling Inc. uses reasonable administrative, organizational, and technical safeguards designed to protect information under our control from unauthorized access, use, alteration, loss, or disclosure.
However, no mobile application, computer system, electronic storage system, device, network, or method of electronic transmission can be guaranteed to be completely secure.
Accordingly, while we take reasonable measures to protect information, we cannot guarantee absolute security or that unauthorized access, loss, misuse, alteration, or disclosure will never occur.
Users are responsible for maintaining the security of their devices, accounts, passwords, credentials, and other authentication information.
Color Match may be distributed through platforms that assign their own age or content-suitability ratings, including a 9+ rating where applicable.
A platform age rating relates primarily to the suitability of an application's content and does not, by itself, establish the age at which an individual may legally consent to the collection or processing of personal information.
Use of Color Match by minors is subject to applicable laws, jurisdictional requirements, platform requirements, and any parental or guardian consent requirements that may apply.
Agile Styling Inc. does not knowingly seek to collect personal information from children in circumstances where applicable law requires parental or guardian authorization and such authorization has not been obtained.
If we become aware that personal information relating to a child has been collected or processed in violation of applicable law, we will take appropriate steps to delete, restrict, or otherwise handle that information as required.

Depending on the infrastructure and service providers used to operate Color Match, information may be processed or maintained in jurisdictions other than the jurisdiction in which a user resides.
Where required by applicable law, we take reasonable measures concerning the processing of personal information across jurisdictions.
Privacy and data-protection laws may differ among jurisdictions, and information may be subject to lawful access by courts, governmental authorities, or law-enforcement agencies in jurisdictions where it is processed or maintained.
Color Match and its features may evolve over time. We may update this Privacy Policy to reflect changes to the App, our technology, our practices, applicable laws, regulatory requirements, or operational considerations.
When this Privacy Policy is updated, we will revise the "Last Updated" date shown at the top of the policy.
Where required by applicable law, we will provide additional notice or obtain consent before materially changing how personal information is handled.
Users are encouraged to review this Privacy Policy periodically.
Nothing in this Privacy Policy is intended to exclude, waive, or limit any privacy or data-protection right, obligation, or remedy that cannot lawfully be excluded, waived, or limited.
